Nothing in these terms limits or excludes a consumer’s statutory rights under the Consumer Rights Act 2015.
Vehicle Condition – Used Vehicles
All vehicles sold by Town Autos are used vehicles, unless stated otherwise. Used vehicles will show signs of age,
mileage, and fair wear and tear consistent with their age and use. Customers are strongly advised to inspect and
test drive the vehicle before purchase. Any defects that are visible, disclosed by Town Autos, or reasonably
identifiable at the time of inspection cannot later be claimed as faults.
Payment & Collection
Full payment must be made and cleared before vehicle collection.
A deposit may be required to secure a vehicle.
Vehicles must be collected within 14 days of notification, unless agreed otherwise in writing.
Note: The document also states that normally a customer has to collect the car within 10 days of deposit
(or an agreed date).
Cancellation & Deposits
A reservation deposit paid to secure a vehicle prior to viewing is refundable if, upon viewing and test driving,
the Customer decides not to proceed with the purchase.
Where a deposit is paid after the Customer has viewed and test driven the vehicle and agreed to purchase it,
the deposit becomes strictly non-refundable (reflecting removal from sale, lost sales opportunities,
administrative costs, and remarketing).
If the Customer fails to complete the purchase without lawful reason, the Company reserves the right to retain the deposit.
Delivery
Delivery is arranged through a third-party transport provider.
Delivery charges are non-refundable under any circumstances.
Risk in the vehicle passes to the Customer upon collection or delivery.
Ownership & Risk
Risk passes to the customer once the vehicle is collected or delivered. Legal ownership remains with Town Autos
until full payment is received in cleared funds.
Seven Day Money Back Guarantee
Town Autos offers a voluntary Seven Day Money Back Guarantee in addition to statutory rights.
Return window
Return within seven calendar days from collection/delivery.
Mileage limit
Must not exceed 150 miles beyond handover mileage. Excess charged at £1 per mile (deducted from refund).
Condition & items
Return in same condition (reasonable wear and tear only) with all keys, documents, service books,
locking wheel nuts, manuals, and accessories.
Refund timing
Processed within 14 working days after inspection and acceptance. Delivery charges are strictly non-refundable.
The Company may deduct reasonable sums for excess mileage, damage, misuse, missing items, excessive cleaning, or mechanical neglect.
Part Exchange Vehicles
Part exchange vehicles must be owned outright (or capable of finance settlement) and delivered in the same condition
as when inspected. If these conditions are not met, the allowance may be reduced or withdrawn.
Distance Sales (Online or Telephone Purchases)
Where a vehicle is purchased without the Customer physically viewing it at our premises, the Customer may have the
right to cancel within fourteen days beginning the day after delivery.
If cancellation rights are exercised, the vehicle must be returned at the Customer’s expense.
The Customer is responsible for any diminished value resulting from handling beyond what is necessary to establish
the vehicle’s nature, characteristics, and functioning.
Delivery charges remain non-refundable.
Storage Charges
Town Autos reserves the right to charge reasonable daily storage fees for vehicles not collected or returned within the agreed timeframes.
Wear and Tear – Excluded Items
The following items are classified as wear and tear or service-related components and are not covered:
Timing chains and timing belts (deteriorate through normal use; replace per manufacturer schedules)
Diesel Particulate Filter (DPF) systems (condition/regeneration depends on usage and maintenance)
Auxiliary belts and tensioners
Clutches and dual-mass flywheels
Brake discs, pads and calipers
Batteries
Servicing & Maintenance
The vehicle must be serviced in line with manufacturer recommendations.
Failure to maintain the vehicle correctly may invalidate any after-sales consideration.
Misuse or Negligence
Claims will not be accepted where faults arise from:
Continued driving after warning lights appear
Overheating or oil pressure warnings ignored
Incorrect fuel usage
Vehicle modifications or engine remapping
Accidental or impact damage
Warranty (Where Supplied)
Where a warranty is included or purchased, it is provided by an independent warranty company. All warranty claims are
subject to the warranty provider’s own terms and conditions. Standard warranties do not cover wear and tear, service
items, or maintenance-related failures. Unauthorized repairs will not be reimbursed under any circumstances.
After-Sales Claims Procedure
Reporting a fault
Any mechanical or electrical fault must be reported to Town Autos as soon as it becomes apparent. If a fault develops,
the customer must stop using the vehicle immediately if continued use may worsen the issue.
Repair procedure
The customer must provide a written diagnostic report from a registered garage before any claim is considered.
The report must clearly identify the cause of the fault (fault codes/verbal opinions alone are not sufficient).
For repair and return, the vehicle must be returned to Town Autos’ premises for inspection before any repairs are carried out.
No third-party repairs are authorized without prior written approval.
Unauthorized repairs will not be reimbursed.
Limitation of Liability
If a claim is accepted, liability is limited to repair or replacement of the affected component only.
Recovery costs, storage charges, hire vehicles and consequential losses are not covered.
Vehicle Return for Inspection
Any vehicle requiring inspection or repair must be returned to Town Autos’ premises. If the vehicle is not drivable,
recovery costs are the customer’s responsibility, unless agreed otherwise in writing.
If Town Autos is required to recover the vehicle, a recovery charge of £250 will be invoiced
to the Customer and must be paid upon demand.
Faults within the First 30 Days
If a fault occurs within the first 30 days of ownership, Town Autos will inspect the vehicle and a repair will be offered
where appropriate. If the vehicle is deemed unsatisfactory under the Consumer Rights Act 2015, the customer may have the
right to reject the vehicle.
Faults After 30 Days
If a fault develops after 30 days, Town Autos must be given a final opportunity to repair the vehicle before a rejection is considered.
Town Autos accepts no liability for faults caused by wear and tear, misuse, or lack of maintenance after delivery.
The customer is responsible for returning the vehicle. If Town Autos is required to recover the vehicle, a £250
recovery charge will be invoiced and must be paid upon demand.
Refunds
Where a refund is due, it will be made using the original payment method within fourteen working days of the vehicle being returned and accepted.
The Company reserves the right to deduct any lawful charges before issuing a refund. (Refund will be made within 14 days of inspection.)
Diagnostic Disputes
Town Autos reserves the right to carry out its own inspection or obtain an independent assessment. Our findings will be used to determine liability.
Manufacturer Recalls
Manufacturer recalls are handled by authorized main dealers at no cost to the customer. Vehicles are checked for outstanding recalls where reasonably possible prior to sale.
Insurance & Road Tax
Customers are responsible for arranging insurance and ensuring that road tax is valid from the point of collection.
Town Autos is not responsible for any loss, damage, or legal liability prior to collection.
Data Protection
Town Autos collects and processes personal data for the purposes of sale, finance, warranty, and statutory compliance.
Personal data will not be shared with third parties except as required by law or with the customer’s consent.
Acceptance of Terms
By purchasing a vehicle from Town Autos, the customer confirms acceptance of these After-Sales Terms & Conditions.
Title and Ownership
Ownership of the vehicle shall not pass to the Customer until full cleared funds have been received by the Company.
Until ownership passes, the Company retains full legal title to the vehicle.
